A NY no fault divorce is one of the reasons that you can petition to get a divorce.


This bill was passed in July of 2010. Up until that time, if you wanted to get a divorce in the state of New York you would have to petition under a fault-based criterion or enter into a separation arrangement.

If you are a resident of the state of Maryland you can still file a petition based on fault.  A divorce in this state may be granted on any of these conditions: adultery, desertion, cruelty or domestic violence, a separation that has lasted for two years, insanity or the conviction of a felony.

In the state of Pennsylvania before you can even petition for a divorce, you must have resided in the state for at least six months. In PA, the grounds are different from those of either NY or Maryland. In this state, you can file for a fault divorce, a mutual consent divorce or on the grounds that the marriage has had an irretrievable breakdown.

If you want to petition for a divorce in the state of Massachusetts you must have been a resident of the state for at least one year prior to the date of filing. The grounds for divorce in this state are different from those of the three states listed above. In this state, a divorce may be granted due to anyone of the following reasons: impotency, drug or alcohol addiction, adultery, wilful neglect, incarceration, desertion or an irretrievable breakdown.

As you can clearly see there are very different grounds for divorce in each of these states. These are only the beginning, when it comes to the laws and regulations that vary between each state regarding separation and divorce. This is why it s vital that when filing for divorce, or the “dissolution of marriage”, you get the correct forms.

If you are thinking of dissolving your marriage, regardless of where you reside, you should investigate using mediation. If you and your spouse cannot come to terms and file an uncontested divorce, this alternative can save you both time and money.
